These Sales and Return Terms apply when ordering physical goods from Müsteeriumite OÜ through the Müsteeriumite Ministeerium website. The purpose of these Terms is to provide a clear overview of ordering, payment, delivery, the right of withdrawal, and the submission of complaints before a purchase is made.
1. Seller
The seller is Müsteeriumite OÜ, registry code 17037645, address Pikk tn 66-11, Rakvere, Estonia.
Contact: info@müsteeriumite.ee. Website: müsteeriumite.ee.
2. Products and prices
The main characteristics, available variants, and price of a product are displayed on the website and in Stripe's payment environment. Product photographs are illustrative, and the actual colour or placement may differ slightly from what is shown in the photograph due to screen settings, the material, and the production process.
Müsteeriumite OÜ is not registered for VAT, and VAT is not added to the price. Any delivery charge is displayed to the customer before payment is confirmed or described in the order view.
3. Placing an order and entering into a contract
To place an order, the customer selects a product and, where necessary, its colour, size, and other required options, enters the contact and delivery details necessary to fulfil the order, and pays in Stripe's payment environment.
The sales contract is deemed concluded after payment has been successfully confirmed and the customer has received confirmation of the order. The customer is responsible for ensuring that the information submitted with the order, including the size, colour, telephone number, and parcel-machine details, is correct.
4. Payment
Goods are paid for through Stripe's payment environment using the payment methods offered there. Payment data is processed by Stripe, and Müsteeriumite OÜ does not receive or store the customer's complete payment card details.
5. Production and printing partner
Merchandise products may be produced or finished after the order has been placed by Müsteeriumite OÜ's printing partner. We provide the printing partner only with the order and delivery data necessary to fulfil the order.
The fact that a standard product is produced or printed after an order is placed does not in itself exclude the consumer's statutory right of withdrawal. An exception may apply only where goods are made according to the customer's personal needs or individual instructions in such a way that they constitute a clearly personalised custom order.
6. Delivery
The order will be sent to the parcel machine selected or entered by the customer or delivered in another manner agreed when the order is placed. The customer must provide a correct telephone number and the exact name of the parcel machine for delivery.
The estimated delivery time may depend on the printing partner's production time and the logistics service provider. If a specific delivery time has not been separately agreed when the order is placed, the order will be fulfilled without undue delay. We will notify the customer of any significant delay at the earliest opportunity.
7. 14-day right of withdrawal
As a general rule, a consumer has the right to withdraw from a distance sales contract without giving a reason within 14 days from the day on which the consumer or a third party designated by the consumer receives the goods.
To withdraw, send an unambiguous notice of withdrawal within the 14-day period to info@müsteeriumite.ee. Please include your name, order number, the product being returned, and contact details in the notice.
After submitting the notice of withdrawal, the goods must be sent back no later than within 14 days. Unless otherwise agreed, the direct costs of returning the goods are borne by the customer.
The right of withdrawal does not apply, among other things, to goods made according to the customer's personal needs or individual conditions provided by the customer and which are therefore clearly personalised. Selecting a standard size or a standard colour offered by Müsteeriumite Ministeerium does not automatically make a product a personalised custom order.
8. Examining the goods and diminished value
The customer may examine the product in the manner necessary to ascertain its nature, characteristics, and functioning, in the same way as in a physical shop. If the goods have been used more than necessary for such examination, Müsteeriumite OÜ may claim compensation for the diminished value of the goods to the extent permitted by law.
9. Refunds
In the event of a valid withdrawal, we will refund the payments received from the customer, including the cost of standard delivery to the extent required by law, without undue delay and generally no later than within 14 days of receiving the notice of withdrawal.
The seller has the right to withhold the refund until the goods have been returned or the customer has provided evidence of having sent back the goods, whichever occurs first. Where possible, the refund will be made using the same payment method that the customer used for the purchase.
10. Defective or incorrect goods
If the goods sent are incorrect, damaged, or do not conform to the contract, please notify us in writing at the earliest opportunity. The consumer has the right to submit a complaint concerning a defect in the goods within the period prescribed by law, namely within two years from the date the goods are received.
For defective goods, Müsteeriumite OÜ bears the justified costs related to repair, replacement, or remedying the defect to the extent provided by law. We generally respond to a written complaint within 15 days.
11. Changing or cancelling an order before dispatch
If you notice an error in the size, colour, parcel machine, or other order details after placing the order, contact us as soon as possible. If the order has not yet been sent to production or dispatch, we will try to make the change where possible. The possibility of making a change cannot be guaranteed once production or logistics has begun.
12. Dispute resolution
If a problem arises, please first contact Müsteeriumite OÜ so that an agreed solution can be found.
If the consumer and trader are unable to resolve the dispute, the consumer has the right to refer the matter to the Consumer Disputes Committee operating at the Estonian Consumer Protection and Technical Regulatory Authority or to a court.
13. Changes to the Terms
Müsteeriumite OÜ may change the Terms if sales arrangements, service providers, or legal requirements change. The Terms in force when a particular order is placed apply to that order.
